Nevada Permit Lifts Tesla Robotaxi Cap to 5,000

Nevada regulators lifted Tesla Robotaxi's ten-vehicle interim cap to 5,000 for Clark County, while Tesla's own Cybercab chief engineer told the Authority the company won't come close to that number.

The Nevada Transportation Authority has authorized Tesla Robotaxi, LLC to operate up to 5,000 fully autonomous vehicles in Clark County over the next 12 months, lifting a ten-vehicle ceiling the agency had imposed less than four weeks earlier. The interim restriction was set out in AVNC Permit 002, issued July 27, 2026 under Docket 26-05015, which confined service to the Las Vegas Strip corridor and barred pickups near Harry Reid International Airport. Tesla Robotaxi had applied on June 5, 2026 for a temporary permit covering 5,000 autonomous vehicles. The Authority approved the expanded permit unanimously last week alongside permits for Uber and Waymo.

What the Interim Permit Actually Required

AVNC Permit 002 granted Tesla Robotaxi authority to carry passengers and baggage by fully autonomous vehicle under NRS Chapter 482A, within an Authority-approved Operational Design Domain and defined geofence. All trips had to originate and terminate within Clark County, limited to the Las Vegas Strip corridor.

The restrictions were specific. Fleet size was capped at ten vehicles. Any change to the approved ODD — including geofence, mapping, or operating parameters — required prior Authority approval under NRS 482A.100. Passenger transportation was prohibited on roadways posted above 45 mph. Every vehicle had to be marked “Robotaxi,” and passengers had to be notified before each trip that a driverless autonomous vehicle was providing the ride.

Two clauses stand out for AV operators. The order requires that operations “include appropriate human supervision in accordance with applicable Society of Automotive Engineers (SAE) standards” — language that ties a state permit condition directly to SAE’s automation-level framework without specifying which level applies. And it obligates the permittee to report to the Authority within five working days any accident, security incident, system failure, communication or data interruption, or event leaving a Robotaxi disabled or inoperable on a Nevada roadway.

The Authority also made clear the permit is neither a franchise nor irrevocable, and cannot be sold or transferred without prior approval.

Will Tesla Reach 5,000?

Tesla’s own engineering leadership told the Authority it will not. Eric Early, Tesla’s Cybercab chief engineer, said during the meeting that “The 5,000 has always been a ceiling for us,” and told the Authority he does not expect the company to be in a position to deploy 5,000 vehicles within a year — a constraint he attributed to factors other than the technology. Early said Tesla would be satisfied reaching roughly 2,500 vehicles, or somewhat above that, over the next year. TechCrunch reported that testimony from Tesla and the other applicants suggested none of the three would approach their permitted ceilings.

Tesla’s Nevada operation follows its Texas deployment, where the company removed in-vehicle safety monitors from public Austin rides earlier this year.

Opposition from Nevada’s Taxi Operators

Nevada Yellow Cab Corp., Nevada Checker Cab Corp., Nevada Star Cab Corp. and others petitioned the Authority in July, arguing that Tesla Robotaxi’s request would remake the regulatory framework governing passenger transportation statewide and produce immediate, substantial effects on their businesses, employees, and regulatory rights. At the hearing, representatives of the Livery Operators Association and local taxi companies argued the approvals moved too far too fast, citing oversaturation of the commercial transportation industry and roadway crowding in the area between the airport and Las Vegas Boulevard.
